Sir,

In compliance with the request contained in paragraph 1 of your Despatch No.. 177 of the 16th. June, 1911, I have the honour to submit a new draft of the Bill providing for the issue of notes in Hongkong by the Mercantile Bank of India, Limited.

2.

In the new draft the definition of Secretary of State has been omitted from clause 2 as it is deemed unnecessary. The expression only occurs once in the Bill (in clause 4) and is defined by section 39-A of Ordinance No. 31 of 1911.

Clause 3 (2) no longer contains the provi -so authorising the issue of dollar notes which was objected to in the third paragraph of the Despatch of the 5th. June, 1911,

from the Secretary to the Treasury to the Under Secretary of

State for the Colonies.

Clause 3 (3) has had added to it a new

paragraph based on section 9 of the Trinidad and Tobago Ordi-

-nance No. 14 of 1903 which was suggested in paragraph 2 (a) of

lir. Bertram Cox's despatch in place of clauses 3 (4), 3 (5),

and 3 (6) of the original draft and in which the Lords Com-

-missioners of His Majesty's Treasury concurred.
